1. Scope

The following Conditions of Participation govern the prerequisites, rights and obligations for admission to the Motel One Creator Club.

Eligibility and application process

a) Admission to the Club is open only to natural persons who:

- are active as an influencer and have a relevant reach,

- are at least 18 years of age,

- have a publicly accessible social media profile.

Participation in our One Creator Club is open worldwide, including the USA and other non-EU countries. The relevant legal requirements and data protection regulations apply, particularly with regard to the processing of personal data.

b) You can submit your application using the contact form or via a direct invitation from us. You must

- have completed the application form in full

- have provided evidence of your social media presence and

- have agreed to these Conditions of Participation and the data protection information.

c) We review your applications according to internal criteria and decide whether to accept you into the Club. There is no entitlement to membership. We do not give reasons for rejections.

2. Obligations of members

a) You undertake to treat all Club benefits and information as confidential and not to convey these to third parties.

b) Within the scope of our collaboration, you undertake to comply with our specifications and those of our partners, in particular with regard to labelling obligations under applicable advertising law.

c) We reserve the right to exclude members who violate these terms and conditions or any legal requirements from the Club.

3. Termination of membership

a) Your membership ends:

- through termination,

- through exclusion from the Club by us or

- through the closure of the Creator Club by us.

b) You can terminate your membership at any time without giving reasons. You can submit your termination by email or via the link below.

c) We may exclude members for good cause, in particular in the case of:

- Violations of the Conditions of Participation,

- Non-compliance with collaboration requirements or

- Violation of statutory regulations, in particular competition law.

4. Changes to the Conditions of Participation

a) We reserve the right to change or amend these Conditions of Participation at any time. We will inform you of any changes in an appropriate manner.

b) If you do not object to the amended conditions within 14 days of notification, the changes shall be deemed to have been accepted.

5. Disclaimer

a) We are not liable for technical malfunctions, failures or loss of data in connection with the use of our Club.

b) We assume no liability for the content you have published as part of our collaboration.

6. Closing provisions

a) The law of the Federal Republic of Germany shall apply with the exclusion of the UN Convention on Contracts for the International Sale of Goods.

b) The exclusive place of jurisdiction for disputes arising from these Conditions of Participation is Germany.

c) Should an individual clause of the Conditions of Participation be or become invalid, the validity of the remaining clauses will remain unaffected.
